It’s no secret that Olympic champion swimmer Michael Phelps is into poker and enjoys spending time in casinos. He's friends with some poker pros, including Antonio Esfandiari.
According to TMZ, Phelps, who was hit along with his second lifetime DUI on Tuesday morning, was cards at Horseshoe Casino Baltimore shortly before getting pulled over.
Phelps was pulled over only some miles from the casino at around 1:40 a.m.
According to the Associated Press, Phelps allegedly registered .14 percent on a blood-alcohol test after he was stopped for speeding. The legal limit in Maryland is .08.
He was going 84 miles per hour in a 45-mph zone, police said.
The AP report added:
Phelps was placed under arrest after initially refusing to take the only leg stand test. Shortly afterward, the officer wrote, Phelps asked to take the test by the side of the road, but “appeared disoriented, argumentative and didn't attempt the test.”
Phelps’ trial is scheduled for Nov. 19.
He faces as much as three hundred and sixty five days in jail, a $1,000 fine and the lack of his driver’s license for 6 months, but since his last DUI was nearly 10 years ago, he could receive probation again.
“He’s likely to be eaten by a polar bear than visit jail for a year,” attorney Leonard Shapiro, a former prosecutor with the Baltimore County State’s Attorney, told the AP.
“If incarcerated at all, it’ll likely be for a weekend.
